ITC order may ban older iOS devices in the US, Apple to appeal

The patent war between Apple and Samsung has not abated and the latest development has seen the conclusion of a case that Samsung had opened with the International Trade Commision (ITC) in 2011. The result of the ITC ruling, the original of which AllThingsD is hosting, is that several older Apple devices were found to infringe on Samsung’s patents..

Apple has said that they will be appealing the ITC decision but, should their appeal fail, then the ruling could put the brakes on sales of some models of Apple’s iPhone 4, iPhone 3, iPhone 3GS, iPad 3G and iPad 2 3G in the States.

The patent in question deals with encodes and decodes of information on a CDMA cellular network which Ars Technica reports formed part of Samsung’s counterattack to Apple’s attack on Samsung’s Android devices.

Apple spokeswoman Kristin Huguet said in a statement to Reuters “We are disappointed that the commission has overturned an earlier ruling and we plan to appeal. Today’s decision has no impact on the availability of Apple products in the United States.”
