Galaxy Tab 10.1 injunction won’t be lifted just yet

Judge Lucy Koh, who presided over Apple’s recent courtroom win over Samsung, has declined to reverse the ban on Samsung’s Galaxy Tab 10.1, despite the fact that the jury in the found that the device did not infringe on Apple’s design patents.

Judge Koh said in her ruling yesterday that, given that the matter of the injunction is before an appeals court at the moment, it would be improper for her to lift the ban. Samsung’s motion does create the possibility that the appeals court could simply refer the matter back to Judge Koh however, which should lead to the injunction being lifted.

There are still other matters to be heard, scheduled for December this year. Apple is hoping to have injunctions placed on several other Samsung devices including several members of the Galaxy S family.
